Memorandum of Understanding
Following the ECJ decision on the Achmea vs Slovak Republic case (C 284/16) that ruled that arbitral investment clauses in that intra-EU Bilateral Investment Treaties are contrary to EU law, Malta together with the other EU Member States have taken a commitment to terminate their intra-EU BITs, as per ‘Declaration of the Member States of 15 January 2019 on the legal consequences of the Achmea judgment and on investment protection’.
